Garda Commissioner to direct all Gardaí to not penalise pubs selling alcohol outdoors

Garda Commissioner Drew Harris will issue a direction to all Gardaí to not penalise pubs and restaurants selling alcohol to people sitting in outdoor seating areas.

Temporary outdoor seating areas have been set up around the country in hospitality settings due to Covid-19 restrictions.


Yesterday, Gardaí said that selling alcohol in temporary outdoor seating areas was in breach of the law.

Last week in Galway, a number of pubs were told by Gardaí that they were in breach of the law.

The Garda Commissioner is to issue a statement to all Gardaí instructing them to use discretion in enforcing licensing laws.


Minister for Justice Heather Humphreys said this morning that Drew Harris has assured her that Gardaí will apply discretion.

She continued to say that if changes need to be made to facilitate hospitality businesses in serving outdoors, Government will make necessary changes.
